Service Terms
1. Agreement And Service
These terms govern NorthCan Safety Hub, also called NorthCan 360°, provided by NorthCan Safety (“NorthCan”, “we”, “us”). You agree when you affirmatively accept these terms through the Hub. If acting for a company, you confirm that you have authority for the commitments you make on its behalf. A separate written service agreement signed with NorthCan takes priority where it expressly changes these terms.
The Hub organizes workplace safety records, forms, certifications, actions and communications. Advisory work, inspections and training delivery are separate services unless expressly included in a written agreement. The Privacy Policy explains our information handling.
2. Accounts And Company Administration
Use accurate registration details, safeguard your credentials and do not share a login. You are responsible for activity you authorize and must promptly report suspected compromise. Company owners manage invitations, permissions, member access and billing. They must keep an authorized owner in place and ensure that the company has the right to collect, upload and share its records.
Only an owner can purchase or manage the company subscription through the Hub. Member limits include registered owners, managers and workers. Removing workspace access is different from deleting a personal login; retained workplace records may still identify former members.
3. Safety Responsibilities And Acceptable Use
The Hub is a documentation tool. It does not certify legal or COR compliance, determine whether work is safe, replace competent supervision, or provide emergency response. Employers and workplace parties remain responsible for hazard assessment, controls, required training, records and external reporting. Check the current requirements for your jurisdiction and work.
Review information before submitting or signing. A signature records the user’s action and associated record; it does not guarantee the accuracy of the content or the validity of every legal signing requirement. Do not falsify records, impersonate others, upload unlawful material, infringe rights, bypass access controls, interfere with the service or introduce malicious software.
4. Your Content And Our Software
You and your company retain your respective rights in uploaded content. You authorize NorthCan and its providers to store, process, display, transmit and reproduce that content as needed to provide the service, follow authorized instructions and comply with law. This permission does not transfer ownership of your content to NorthCan.
NorthCan and its licensors retain rights in the Hub software, branding and supplied materials. You may use available templates within your organization’s safety program while observing any stated third-party terms. Do not resell the service or represent NorthCan’s templates as a certification or approval.
5. Prices, Payments And Renewal
Displayed plan prices are in Canadian dollars, plus applicable taxes. The current options are Starter at $49 per month or $490 per year, Team at $149 per month or $1,490 per year, and Business at $299 per month or $2,990 per year. The checkout summary controls the specific amount, billing frequency and taxes you authorize. Annual plans are paid upfront.
Paid subscriptions begin only after an authorized owner completes checkout and payment is confirmed. Subscriptions renew automatically at the selected interval until cancelled. The owner must affirmatively authorize the recurring payment before checkout. A free pilot does not automatically become a paid subscription, and a plan preview alone does not create a charge.
Stripe handles payment credentials, invoices and payment-method management. Keep billing details current. Payment failures may result in a read-only workspace or suspension of paid features. Records remain available for viewing and export within existing permissions while the workspace remains open. Contact support if you need assistance resolving a billing error.
We will give advance notice of changes to the price or renewal terms for an existing subscription, provide a way to cancel before the change takes effect, and obtain further agreement where required by law. A price update on the public plans page does not by itself change an existing subscription.
6. Cancellation And Refunds
The owner can stop automatic renewal in Billing or the Stripe billing portal. Ordinary cancellation takes effect at the end of the current paid period; the subscription remains usable until that date. Afterward, the open workspace becomes read-only. Save the cancellation confirmation and contact support if the displayed status does not update.
Closing the entire workspace cancels its subscription immediately and ends access for everyone. Transferring ownership keeps the workspace and subscription active under its new owner. Closing a worker’s personal account does not cancel the company’s subscription.
Unused subscription time is not automatically prorated or refunded. Contact NorthCan promptly about duplicate or incorrect charges, or to request a refund review. Any mandatory refund, cancellation or other consumer rights that apply to you remain unaffected by these terms.
7. Availability, Exports And Support
We aim to provide a reliable service, but do not promise uninterrupted availability, a particular response time or guaranteed recovery of every file. Maintenance, provider outages, network loss and software errors can affect operation. Any agreed service level must be set out separately in writing.
Maintain suitable copies of critical records and review saved entries and uploaded files. Drafts, uploads and notifications may fail when connectivity is interrupted. The Hub is not an emergency notification system. Contact support with enough detail to investigate a problem, without exposing passwords or unnecessary sensitive information.
8. Suspension And Closure
We may restrict access when reasonably necessary to address security threats, unlawful use, material misuse or non-payment. Where practical, we will explain the reason and provide an opportunity to resolve it. We may act immediately if delay would create a material risk or conflict with law.
You may close your account through Account closure. Owners must first transfer responsibility or confirm workspace closure. Export necessary records before closing. Company records and required transaction, security or audit information are handled under the retention policy; account closure is not a request to erase every company record.
9. Responsibility And Legal Rights
Each party is responsible for its own conduct and obligations under applicable law. NorthCan does not assume the employer’s safety duties or responsibility for the accuracy of user-entered information. To the extent permitted by law, we do not give implied guarantees that the service will meet every particular operational or compliance requirement.
Nothing in these terms excludes liability or limits a right or remedy that cannot lawfully be excluded or limited. These terms do not waive applicable consumer protections, privacy rights, or liability for fraud or wilful misconduct.
10. Changes And Disputes
We identify the effective version of these terms and provide notice of material changes in the Hub. We request renewed agreement when necessary. Changes do not retroactively remove accrued rights. If you do not agree to a proposed material change, contact NorthCan about export and closure options before it takes effect.
Please contact NorthCan first so we can try to resolve a concern. Subject to mandatory laws that apply to you, these terms are governed by Ontario law and applicable federal Canadian law, with disputes brought before the competent courts of Ontario. Mandatory rights to another forum or remedy are preserved. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
